Fraud, perjury, child molestation, and now terrorism

There’s a particularly disturbing story developing in Northern Ireland:

The police, the Catholic Church and the state conspired to cover up a priest’s suspected role in one of the worst atrocities of the Northern Ireland Troubles, an investigation has found.

Forgetting for a moment the face-palmingly euphemistic name “North Ireland Troubles”, this is a poignant illustration of what happens when religious leaders collude with secular authority. Police found evidence implicating one Father James Chesney, and instead of acting on it, collaborated with politicians and the Church to cover up the evidence and move the suspected terrorist to another parish.

Now I’m sure some of you will think it’s unfair of me to pick on this organization based on acts that were committed 30 years ago, but you’d be missing my point. If the accused had been a member of a secular organization, there would have been no such cover-up or collusion. The Catholic Church wielded (and continues to wield) power that was sufficient to shield its members from any kind of justice. This is another example of the willingness of the RCC to subvert secular authority to preserve their veneer of respectability and shield their power from scrutiny.

Besides, this is not something that happened once 30 years ago and has been dealt with. The Church still refuses to co-operate with secular authority, demanding special exemption from justice at every turn like a petulant child protesting the punishment of a fair parent. When caught and forced to face up to their systemic corruption, they offer non-apologies in the hope of mollifying critics, simultaneously demonstrating that they don’t understand the nature of the problem, and virtually guaranteeing that it will continue in the future.

As disgusted as I am with the RCC for this latest atrocious betrayal of human decency and justice, they cannot accept the entirety of the blame:

[Ombudsman Al Hutchinson] said he told his superiors he was going to raid Fr Chesney’s parochial house within 30 minutes unless he was told to do otherwise. He said he had soldiers standing by in Magherafelt police station as back-up for the search and arrest operation. “They (senior officers) gave me an answer back within 15 minutes that things were under control, not to go. I was told, leave it alone, we’re looking after it. Then the next thing I heard was that he was transferred to Malin Head (in Donegal).”

The corruption was widespread enough to touch the police force, and the political establishment. The entire country was in turmoil, and authorities feared that arresting a priest would result in widespread violence and rioting, touching off a civil war. Perhaps it would have.

The problem is in allowing a group – any group, religious or otherwise – to hold that kind of unchecked power. There was no check on the Catholic Church either from within or externally. The religious authority held such control over both the people and the secular powers that it could thwart the judicial system at its whim. Secular authorities are subject to the approval of the populace (for good or ill), and in many cases are also limited by other branches of government. Religious authorities, however, are accountable only to themselves, and have demonstrated their ability to confuse “the good of the Church” with what is good for the people time after time. There is no mechanism of voting out the Pope, and the threats of excommunication and social ostracism (not to mention hellfire and other fun supernatural punishments) ensured that no citizen group could or would form to check the power of the Church.

Perhaps Ivan Stevenson of Northern Ireland says it best:

The Church is right in saying that they didn’t cover up an evil act. It would seem that the British government offered to do it for them. However, this doesn’t negate their moral responsibility to respond more appropriately. All in all it stinks of hypocrisy, considering recent disclosures relating to child abuse and whatever else lies festering in the closet. The Catholic Church’s self declared divine mandate to be the moral conscience of the world is nothing but the pompous, self-righteous posturing of a large group of very sad and desperate men.

Seems funny but isn’t: Hostage taking at Discovery Channel

This post will be pretty much just a stub. There is currently a hostage situation taking place at the Discovery Channel’s headquarters in Maryland. The assailant, James Lee, has posted a radical list of demands, encompassing environmentalist policy, military intervention, and with particular vitriol for human reproduction. A partial list of demands can be seen at Pharyngula.

I am writing this in order to state clearly and immediately that I repudiate and condemn this action by Mr. Lee, who does not speak for me as an atheist, an environmentalist, a military objector, or a fan of Daniel Quinn. Innocent people should never be used as fodder in an ideological struggle, and I abhor violence as a means of social protest. I encourage all those in the secular movement to do the same – we are quick to malign moderate Christians and Muslims for not speaking up against extremists. We now have an example of a far-left atheist extremist – let’s not forget our principles.

It seems that Mr. Lee is mentally unhinged, and while I hope this standoff ends without anyone being hurt, my concern is for the hostages. I am also not looking forward to watching smug assholes on the right turn this into justification for anti-environmentalism and anti-atheism (which they are virtually guaranteed to do – they love pointing out hypocrisy, as long as it isn’t theirs).

UPDATE: Mr. Lee has been shot and killed by police (3:20 PST). As of 2:30 PST there is no word on his condition, but it seems like he might not be dead.

Is there a worse name than ‘honour killings’?

When you think of the word ‘honour’, it conjures an image of someone who is honest, plain-dealing, and trustworthy. What it doesn’t invoke is the image of a man who murders his children for wearing revealing clothing or dating outside his/her nationality, or for refusing an arranged marriage.

There’s no honour in murder. It is the weak-willed act of a coward who lacks any human decency. One might be able to persuade me that there is honour in the suicide tradition of Bushido, in which failure to act honourably moves the samurai to take his/her own life. I’m generally against the idea of suicide, but a person’s life is their own to do with what they want. What he is not entitled to do, however, is murder someone else to restore his own sense of ‘honour’. Any society in which one person’s mental state or social status trumps another’s right to the security of their person cannot stand.

India seems to be realizing this:

India’s home minister proposed Thursday a bill to provide specific, severe penalties to curb honour killings, saying they brought “dishonour” to India as a secular, modern democracy. “We are living in the 21st century and there is a need to amend the current law and the law must reflect what the 21st century requires,” he said. “We have to look ahead and build a society that is based on secular values and enlightened views.”

I’ve talked previously about the social climate changing for women in India. The linked article mentions that there has been an upswing of violence against women in India, and that it is necessary to make changes in the status quo if India wishes to achieve its goal of being seen as a major world power. Let it never be said that international peer pressure and secularism can’t make the world a better place to live. There are around 500 million women in India who would likely agree.

The problem with passing these kinds of laws, however, is that murder is a crime. I am still uneasy about punishing people extra for the reasons behind why they commit crimes. Punishing specific groups of people for committing certain types of crimes against other specific groups is ethically dicey ground. Is it still an ‘honour killing’ if a non-religious man kills his son for being gay, or his daughter for dating a black man? Maybe it is, and if there’s a way to state that unambiguously, I’ll be interested to hear it.

Canada seems to be realizing this:

Justice Minister Rob Nicholson says prosecuting honour crimes is a priority for the government but that there isn’t any real need to change the Criminal Code.

Murder is wrong, and that must always be the focus. If passing specific statutes against honour killing will make it happen less, then that’s a discussion we can have. I doubt very much, however, that adding on a few extra years to a life sentence is going to meaningfully demotivate a person who is willing to murder his/her children from committing the act. The way to approach these things is that we have to model and encourage secular values of respect for the integrity of a human’s autonomy and security of person, and discourage the equation of “faithfulness” with righteousness.

Every time I hear of an honour killing, there is an almost-overwhelming temptation to immediately blame religion. The stories that get the most press are those in which the murderers are Muslim or immigrants from Muslim countries. I’m skeptical of this explanation for being overly simplistic, not to mention the fact that this type of killing is not founded in Qu’ranic verse. It’s sort of like when an abortion doctor is murdered by a Christian fundamentalist – it’s a flawed interpretation of scripture (which is, in itself, flawed, but we won’t go into that here) and isn’t an accurate reflection of doctrine. The problem is the belief that underlies both Christianity and Islam (and all religions) – that there exists an unobservable external standard which is accountable only to itself, but to which all of humanity is subject; and further, that this standard is not based on something reasonable like observable consequences to humankind, but based only on how fervently you believe in it. Sexism, homophobia, xenophobia and the like existed in the societies that spawned these religions, and they persist today. Blaming a book for a human failing neglects the larger and more accurate story that’s going on.

Malaysian courts reach the 1980s

To be fair, lagging only 30 years behind is a pretty immense feat for a theocracy, especially one as messed up as Malaysia

There are two big news stories out of Malaysia that are making headlines:

1. Malaysia appoints first female Shariah court judges

Malaysia’s first women Islamic court judges are starting to hear cases this month after Shariah legal authorities gave them the same authority as their male colleagues, an official said Wednesday.

I can’t pretend to be thrilled that it’s a religious court that these women have been appointed to – the very idea of a religious court is a perversion of the concept of justice – but it is measurable progress insofar as it is an official recognition that women can wield equal legal authority to men. Consider that Canada appointed its first female Supreme Court justice in 1982 (for those of you who keep track of this sort of thing, that’s one year after Reagan appointed Sandra Day O’Connor to the US Supreme Court). My most optimistic scenario here is that the presence of female judges will shift the balance toward equality for women in the courts. My least optimistic is that these women are either anti-feminist or will be so cowed by the religious authority that they will make even more sexist rulings.

Again, lest we feel too smug and superior about the west, Venice just licensed its first-ever female gondolier. Way to go, Italy.

2. Malaysian men denied clemency for poorly-constructed religious excuse

Both Richard Dawkins and Christopher Hitchens delight in pointing out that religious people have very little to fear from atheists. A common tactic is to talk about how churches will be torn down or burned by atheist activists in their zeal to punish thoughtcrime – Dawkins/Hitchens rebut that the religious do a far better job of desecrating each other’s holy sites than atheists ever will. This story out of Malaysia is no exception to that:

The attack on the Metro Tabernacle Church in Kuala Lumpur was the first of a series of attacks on houses of worship following the “Allah” row. Eleven churches, one Sikh temple, three mosques and two Muslim prayer rooms became targets of arson and other incidents.

Non-Muslim churches are using the word ‘Allah’ in Malay as a placeholder for God (much in the same way I use ‘YahwAlladdha’, although without the associated mockery). Some Malaysian Muslims are incensed by the violation of their trademark, saying that Christians are hatching a devious plot to make Christianity look more like Islam in order to gain converts. People of Malaysia: your religious leaders think that you are functionally retarded. Recently, a number of sites of worship were torched as reprisal for the semantic issue. Two men caught and charged with setting the fires tried to plead out by saying they burned themselves at a barbecue.

Luckily, the judiciary appears to be a bit more sane than either the accused or the religious leaders, and charged the morons appropriately. Of course there’s a whole host of other religious nonsense underlying the issue (there always is), but at least the judges made the right decision.

I might have to revise my opinion of Malaysia based on this new information. Of course, it still remains a crime to convert from Islam to another religion (or, I’d imagine, no religion at all), and they’re still wildly homophobic, but Rome wasn’t built (and then converted and sodomized) in a day.

Home-grown religious huxter

When I was at that “debate” between Hugh Ross and Brian Lynchehaun, Brian made what I thought was an interesting point toward the end. He asked the audience to picture a circumstance in which a loved one was dying a painful death, with no hope of a medical cure. Someone offers you a chance to visit a faith healer, who promises a miraculous result, and all it will cost you is your life savings. Left with your back against the wall and no other options, would you take that chance?

A skeptic atheist wouldn’t, and Brian’s argument was that this is a illustration of how skeptics are less likely to fall for scams than a religious person. It popped into my head when I read this article about a pastor in Montreal:

Several members of the Bethel Christian Community have gone public with troubling allegations about money they say they lent to their spiritual leader — Rev. Mwinda Lezoka, a Congolese native who has ministered to Montreal’s growing African community for two decades.

These are not rich people – these are ordinary working people, some of whom went so far as to remortgage their own homes. They gave their money to a man they trusted, and were not repaid. It turned out that pastor Lezoka was using the money he appropriated for… slightly less divine ends:

During the years Lezoka ministered to his parish at the Bethel Christian Community Church in Ahuntsic, he also studied gemology, and appeared to head a Kinshasa-based export agency specialized in diamond trading.

Lezoka was apparently an administrator of a diamond exporting firm in the Democratic Republic of the Congo (DRC) – the firm has since gone bankrupt. It does not take a great deal of imagination to envisage a scenario in which Lezoka used funds that were loaned to him for the purpose of developing the church in order to prop up his failing investment.

Jewish and Christian scripture exhort the faithful to be honest and fair-dealing. Bearing false witness is in the commandments (God is not cool with it), and that has been extrapolated to include all types of lying. Surely a pastor, one whose life is devoted to the teaching of scripture, once caught in a lie, would come clean and be honest, right?

“I did not take anyone’s money,” said Mwinda Lezoka, speaking in French, in an exclusive interview with CBC News. “So I, Mr. Lezoka, am not responsible for deceiving anyone.” … The pastor was unable to produce any financial records, when asked by CBC News. Nor could he explain why charitable tax receipts he issued have false numbers, according to Revenue Canada.

It’s sad, but unsurprising, when people with religious authority show themselves to be as callow, evasive, and corrupt as people with just regular ol’ Earthly authority. Unsurprising to me, at least, because even while I was a believer I didn’t buy the fiction that priests are somehow more righteous or upstanding than anyone else. To borrow from (and paraphrase) Napoleon, religion is an agreed-upon fiction. It is built firmly on the basis that everyone believes the story – if you do not believe, you cannot be shown evidence to engender belief (the fundamental difference between science and religion). If the morals and righteousness are based upon fiction, there is no end to the number of cognitive dissonances and goalpost shifts possible to justify any act of evil.

I am well aware of the fact that these people might have been duped by anyone. Many people fall for scams that are not religious in any way. However, credulous belief in falsehoods and the associated elevation of people into positions of power and authority (and assumed rectitude) based on those falsehoods makes a person more likely to believe in nonsense. To put it plainly: those who are willing to believe anything are willing to believe anything.

Arizona doesn’t have a race problem

While I have mentioned it tangentially, I haven’t devoted an entire post to what is probably the biggest racial civil rights struggle since the 1960s: Arizona’s new immigration law. In brief, the law requires police officers to detain anyone they suspect of being an illegal immigrant. If a suspected person cannot prove they aren’t an illegal immigrant, they can be arrested and put in jail. When I say that the law requires police to do this, I mean just that – a component of the bill is that if an officer fails to interrogate someone, and a citizen notices it, the officer can be found in dereliction of his/her duty. Basically, the reins of law are turned over to the most paranoid and least informed members of the populace of Arizona.

The reflexive question that everyone immediately asks is “how do you tell if someone looks like an illegal immigrant?” Good question: let’s ask the governor who signed the bill

Huh… even she doesn’t know. Not to worry though, she says. People will have their civil rights protected, as it says in the bill:

“This act shall be implemented in a manner consistent with federal laws regulating immigration, protecting the civil rights of all persons and respecting the privileges and immunities of United States citizens.”

Handy! What about this right?

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

If the law respects the right to be innocent until proven guilty, and the constitution outlaws unreasonable seizure, then the immigration bill is pretty clearly meaningless. After all, if you cannot prove that someone is illegal (which is the standard of innocent until proven guilty), you cannot compel them to prove they are illegal (that pesky 5th Amendment) and you’re not allowed to arrest them arbitrarily, then the bill is moot.

Well, the federal government didn’t argue that case, but still managed to block the bill’s enforcement, arguing instead that immigration policy is the purview of the federal government and that the law went outside the state’s jurisdiction. Of course, Arizona plans to appeal:

Lawyers for Republican governor Jan Brewer and the Arizona government filed their appeal at the 9th Circuit Court of Appeals in San Francisco on Thursday. “I have also asked the 9th Court to expedite the briefing schedule and its ruling, since Congress and the president have once again failed to act,” Ms Brewer said in a statement.

I want to take a moment to talk about the people of Arizona. While I think they’ve made a frighteningly poor decision and are wearing their entrenched racism out on their sleeves, I am loath to condemn them outright. Arizona has major economic problems (which this bill will only make worse, but we’re not dealing with rational people here), and as I’ve said before, racism will bubble up from beneath the surface whenever there is economic hardship. Illegal immigrants are a convenient scapegoat in times of crisis, especially if they are brown-skinned. While people affirm up and down that this isn’t a race issue, it strains credulity to think that the cops are going to be on the hunt for illegal French and German immigrants.

Especially with this guy in charge…

The common temptation is to read the above quote out of context, and to imagine that killing the lawyers will somehow usher in a Utopian society. Certainly we can all think of our favourite lawyer sterotype – the slick corporate lawyer who gets the megacorporation out of having to pay damages, the wily defence lawyer who helps the rich defendant escape punishment, the aggressive divorce lawyer who strips a man of all of his possessions through litigation.

I’d like to add another stereotype to your arsenal: the lawyer who is kidnapped for have the temerity to assert that his client has the right not to be executed for having a boyfriend:

Mohammad Mostafaei, who is defending the woman (Sakineh Mohammadi Ashtani), was called in on Saturday for questioning at Tehran’s Evin prison. Amnesty (International) says he appears to have gone missing after his release. The authorities have since detained his wife and brother-in-law, it says.

I attended a rally here in Vancouver in support of this woman. It was sparsely attended, and largely failed to capture the attention of the crowds going by – highly disappointing. There was one highlight, however. During a speech, the speaker decried the practice of stoning and the oppression of women in Iran, Pakistan and Saudi Arabia. A man in the crowd began shouting his dissent, saying that women were well-treated in Saudi Arabia. The speaker on stage pointed out that women in Saudi Arabia are not allowed to drive. The heckler shot back, and I am not making this up, that they didn’t want to drive. I am gratified that the audience immediately broke out laughing. It is utterly ridiculous to pass a law banning someone from doing something that they don’t want to do in the first place. If the women of Saudi Arabia don’t want to drive, they should be able to choose not to – no need for a law.

At any rate, the execution of this woman appears to be a foregone conclusion. The government of Iran has decided that she is guilty and worthy of death, and no amount of legal argument or international protest seems sufficient to sway them from their course. Considering what’s happening in Iran, and in Gaza, and the ongoing idiocy of Pakistan, it seems like the Middle East is leading the bold charge forward into the 15th century.

UPDATE: Mr. Mostafaei has turned up in Turkey and is seeking asylum there.

South Africa doesn’t have a race problem

I was watching The Daily Show a few weeks ago, during the coverage of the World Cup. John Oliver was talking about race relations in South Africa – to people on the street, to a hard-line racist activist, and to a government minister in charge of racial relations. The most poignant part of the interview for me was when the minister looked John in the eye and told him flat out that South Africa doesn’t have a race problem. I’m glad I wasn’t drinking milk at the time, because it most assuredly would have flown out of my nose as I laughed derisively.

I feel compelled at this point to re-state a maxim that I’ve danced around many times at this blog. It is a central tenet of my approach to race and improving the climate of racial discourse in Canada (and other countries, of course). It is not… It is notIT IS NOT POSSIBLE to simply wish racism away. It is not possible to declare that there is no race problem simply by asserting it and hoping to high heaven that it comes true. Racial issues are deeply entrenched in our society, in our history, and there is some evidence to suggest that elements of it are present in our very human nature. The first step toward progress is recognizing the subtle effect that non-obvious racism has on our day-to-day lives.

Hence my scoffing and incredulity when presented with the statement that “South Africa doesn’t have a race problem”. As though hundreds of years of colonialization, coupled with an absolutist and brutal apartheid regime that existed within my own living memory could somehow be erased by good will and warm, fuzzy feelings. It was times like that I wished I had a roommate, and that the roommate was a bit slow – I would have made a bet. “Within a month of this statement,” I would have said “we’re going to hear about some major race issue out of South Africa.”

I would have won some money.

Four white South Africans have been convicted of humiliating five black university domestic staff after a video of the incident was posted online. The video showed the five staff being made to kneel and forced to eat food which had apparently been urinated on by one of the students.

I don’t speak Africaans (and neither do you, likely) so I can’t translate the video for you, but the actions are pretty clear. The ‘urinating’ in the food is simulated by a water bottle, but wow does that ever not matter. The former students (those rapscallions) claim that they didn’t intend for the video to be humiliating, and that they never would have done it if they had known what the outcome would be. That’s cold comfort for the millions of black South Africans who see the barely-retreated spectre of apartheid – where being black meant that you were legally at the bottom rung of society and had no legal protections – rearing its head in the form of these students forcing hostel workers to eat contaminated food for their entertainment.

But hey, at least justice was done:

The four – RC Malherbe, Johnny Roberts, Schalk van der Merwe and Danie Grobler – were also given six-month prison terms, suspended for five years on condition they are not found guilty of discrimination during that period. The fines of 20,000 rand (~$2,700) were higher than that requested by the prosecution.

“It sends a strong message to potential offenders of similar crimes,” said magistrate Mziwonke Hinxa in the mainly white town of Bloemfontein.

It does send a strong message – if you’re white and have enough money, you can get away with pissing on the rights and dignity (and food) of black people in South Africa.

In a statement read out by their lawyer, the men said the video had been made to demonstrate the traditions of their hall of residence and to protest at plans to make the university more racially mixed.

Well you’ve essentially taken care of that, boys. Why any black person would want to attend the University of the Free State (someone’s been reading George Orwell) is incomprehensible to me.

Online anonymity – a free speech issue?

Can you force free speech on people? That is, is speech still ‘free’ when you have to speak? Certainly denying the rights of people to speak when they want to is wrong, but is it equally wrong to force someone to speak up? It’s a bizarre question, to be sure, but one that seems to be cropping up over and over.

I’ve spoken before about China’s tempestuous relationship with free speech; or maybe I should call it an abusive relationship, since it regularly treads on the speech rights of its citizens. However, there’s something happening right now in China that is making me sit up and take notice:

A leading Chinese internet regulator has vowed to reduce anonymity online, calling for rules to require people to use their real names when buying a mobile phone or going online, according to a human rights group.

The move would have two major implications. The first is that the days of internet trolling and flaming would be pretty much done. You’re going to be a lot less likely to call someone a ‘fagtard fuckstick’ if they can find out who you really are. The second is a bit more chilling though, since the government would also have access to your personal information. Given China’s record for cracking down on dissent of any kind, and the stated policy that “indicate a growing uneasiness toward the multitude of opinions found online.” I’m not so sure this information should be available, even given the problems China is having with its own regulation.

But that’s China’s problem, right? Over here in North America we don’t have to worry about that kind of stuff! Well, that’s not exactly the case:

The maker of the hugely popular World of Warcraft video game has reversed a previous plan that would have required users of its game forums to post under their real names.

I don’t play WoW, but I do have friends who do, and I am familiar with the kinds of abuse that happen on internet sites. I’m also acutely aware that many of the users are young people, for whom that kind of abuse can be truly scarring. In an effort to civilize the forums, Activision/Blizzard announced it would bring in measures to remove anonymity from its forums. The backlash was immediate, with users raising concerns (some legitimate) that publishing that information would make people targets of abuse. Many female gamers use the anonymity to avoid being sexually harassed, and the removal of that layer of protection would likely dissuade them from participation. Ditto for members of minority groups (with them ‘ethnic-sounding’ furriner names). Activision/Blizzard pulled the plug, but something tells me the issue hasn’t gone away. And it’s not just me who thinks so:

Two-thirds of 895 technology experts and stakeholders surveyed about the future of the internet believe the millennial generation, born mainly in the 1980s and 1990s, will make online sharing a lifelong habit, suggests a Pew Research Center and Elon University study released Friday.

One needn’t look much further than Facebook and Twitter (or even FourSquare, which makes even my millennial eyebrows raise in concern) to realize that privacy as it was known previously is on the way out. One also needn’t look much further than those sites to realize that there is huge potential for abuse, with employers firing or refusing to hire people based on their Facebook exploits. Canada’s privacy commissioner has been going round after round with Facebook to get better privacy measures installed. How long before those are a memory, and our whole lives are online? Let’s hope that we have at least a little while longer:

The owner of XY Magazine and its associated website – which catered for young homosexual boys – filed for bankruptcy earlier this year. XY’s creditors have applied for the firm’s one remaining valuable asset: its database of one million users.

This is the privacy nightmare. Not the loss of a job because you posted a drunk picture of you riding a pig, but you getting assaulted by a pig over information that you were told would be kept anonymous. There are many people who are privately gay and who are not prepared to come out in public. Being forced out would be traumatic enough, but to have that information up for sale to whoever wanted it would be disastrous.

So it seems the balance is, at least for now, that privacy does more good than harm. We don’t yet live in a society with sufficient privacy protections that would allow people to be themselves online. Why is this a problem for me? Because the same protections that gay kids and Chinese dissidents and female gamers get are extended to race bigots, Holocaust deniers, and religious zealots. If we have a code of rights to protect privacy, then it also covers the privacy of people whose opinions we don’t like. The goal of free speech is to have ideas out in the open, not cowering behind a shield of anonymity. Activision/Blizzard recognized that, but had to reverse its decision. This seems to be another downside to living in a free society – even assholes are granted freedom.

The tiiiiiimes they are a-changin’!

The 20th century, which saw some of the worst atrocities in the history of the world, also saw some of the greatest social victories. India accomplished its independence from Britain after a long and bloody struggle. A world was spurred to action to halt a racist and homicidal military political machine. Here in North America we saw the women’s suffrage movement finally force the establishment to officially recognize the fact that women are people, not property. Similarly, we saw many major battles won for black civil rights in North America, particularly in the United States, but also right here at home.

The latest battle seems to be the fight for gay rights. As LGBT people struggle to establish equal treatments and protections, the social zeitgeist seems to be moving in their favour. For example, this was front page news a couple weeks ago:

Vancouver Police announced charges Thursday against four men in two separate attacks on gays in Vancouver’s downtown core in recent weeks. Both attacks are being investigated as possible hate crimes, Const. Jana McGuinness said.

The fact that Vancouver has hate crimes is not exactly news, but the part that amazed me is not only that the arrests made front-page news, but how the police were able to apprehend the suspects so quickly:

In the Holtzman-Regier case, McGuinness said police got many tips from the public, especially after video footage of the suspects was released June 18. “It is so important that people get on the phone immediately and report these crimes to police,” she said. “The arrests are coming because we are getting the support and help of the public and we have victims who are willing to report these crimes.”

It seems that the days of victims of assault actually being victims is numbered. So too are the days when the public is willing to tolerate hate-motivated crimes against homosexuals. People are not content to perpetuate the status quo of systemic prejudice against this group of people (and, I hope, any group of people).

The part that I’m not wild about is the fact that the homophobic comments the attackers made can be admitted into court as aggravating factors, possibly netting a longer sentence. Similar to hate speech, I worry about hate crime legislation. I can almost understand the need to provide additional protection to groups that are particularly vulnerable to attack, but I am not a fan of legislating peoples’ feelings. If someone can show me data that hate crime legislation acts as an effective deterrent against assault, I’ll happily sign on; however, if they’re just a feel-good way to give longer prison terms to people whose views we don’t like then I have a big problem with that.

But yes, the social landscape appears to be becoming more equal. At least, if the United Kingdom’s Supreme Court is to be believed:

Two gay men who said they faced persecution in their home countries have the right to asylum in the UK, the Supreme Court has ruled. The panel of judges said it had agreed “unanimously” to allow the appeals from the men, from Cameroon and Iran.

The two men had to appeal their initial decision to the Supreme Court, because the initial ruling they received was that they wouldn’t face persecution if only they’d stop being so gay. Like, seriously guys. Why can’t you just hide your gayness in some kind of… enclosed space? Maybe like a bedroom? No, bedrooms are too big, and they have windows so people might be able to see. Maybe something smaller… with no windows… what could that be?

To my pleased shock and amazement, the presiding judge wrote a decision that I think will become a landmark in the gay rights struggle in the same way that Brown v. Board of Education is for the black civil rights movement:

Lord Hope, who read out the judgement, said: “To compel a homosexual person to pretend that his sexuality does not exist or suppress the behaviour by which to manifest itself is to deny his fundamental right to be who he is. Homosexuals are as much entitled to freedom of association with others who are of the same sexual orientation as people who are straight.”

That’s what equal rights means. Sadly, the government of Cameroon doesn’t seem to get that. If two straight people are allowed to walk down the street holding hands, or smooch on a sidewalk, or any number of things that couples like to do, then passing a set of laws forbidding gay people from doing those same behaviours is persecution. Saying that it’s only okay as long as you don’t get caught is ludicrous hypocrisy – akin to those people here in North America who complain about a gay agenda to ‘turn kids all queermosexual’, and that if they just stopped being so… well so gay all the time then they’d be safe from persecution. The problem isn’t with gay couples, the problem is with anyone who thinks that the rest of the world must conform to private bigotry.
