Terence Crutcher: Cop Charged with Manslaughter.

The white Tulsa police officer who fatally shot an unarmed black man was charged with manslaughter on Thursday and a warrant has been issued for her arrest, Tulsa County District Attorney Stephen Kunzweiler said.

Officer Betty Shelby was charged with first-degree manslaughter for the death of Terence Crutcher, 40. The incident, captured on widely broadcast police videos, is one in a series that has raised questions of racial bias in U.S. policing.

“Although she is charged, she is presumed innocent until a judge or jury determines otherwise,” Kunzweiler said. “I don’t know why things happen in this world the way they do.”

Manslaughter? Really? How about 1st degree murder? “I don’t know why things happen in this world the way they do.” Oh for fuck’s sake! What kind of grade A idiot says something like that? A man was murdered for no reason at all by yet another cop out of control, and with a head stuffed full of stereotypical bigotry. We aren’t talking about some great mystery here, or an unexplained phenomenon. This is an all too regular occurrence, a cop murdering a person of colour. Depressingly fucking normal and typical. Don’t even start with such utter isht, making this out to be something remarkable. The only remarkable thing about this case is that it’s not in the least remarkable.

A lawyer for Shelby has said she acted because she feared for her life, believing Crutcher was reaching into his vehicle for a weapon during the encounter, which took place last Friday.

Yet another cop pleading scaredy-pants. Fuck, fuck, fuck, I’m sick of this. If you are so scared, you need to be stripped of your weapons and ersatz authority, stat. Find another job. Shelby’s partner had his taser out and armed. And her excuse for gunning Mr. Crutcher down? “I was scared.” This disgusting excuse must not be accepted, in any way whatsoever. Cops have all manner of weaponry besides their damn gun. How about they use it, instead of us getting to hear about yet another person of colour being murdered by cops? Instead of hearing about yet another family devastated by trauma and grief?

This constant narrative of cops having such an incredibly dangerous job has to stop. Policing doesn’t even make the top 10 in a list of most dangerous jobs. Lumberjack, deep sea fisherman, bush pilot, miner, personal transport driver, sanitation worker, search and rescue, welder and metal worker, mechanic, electrician, roofer, and firefighter are all  dangerous jobs, and all of them are more dangerous than being a cop. That’s not to say that there’s no danger or risk in policing, of course there is, however, it’s not up to what is always claimed, either. This narrative of constant, extreme danger is mostly swallowed whole by cops themselves, and it whips them up into a froth of fear and deep paranoia, which amplifies implicit bigotry, and you get “scared, so I gunned them down.”

Tulsa police have said Crutcher was unarmed and there was no weapon in the vehicle. In a bid for transparency, they released the videos, one of which was taken from a police helicopter and the other from a dashboard camera in a patrol car.

The U.S. Justice Department has launched a separate investigation to see if the officers on the scene violated Crutcher’s civil rights.

:Chokes:  Violated Mr. Crutcher’s civil rights? Is not being murdered in cold blood a violation of his rights? You have to check around to see if he was violated? Christ. This day, I seriously hate this damned country. (Yes, I know this can be used for additional charges. That does not take the inanity of it away.)

Cops Behaving Badly: Irony Overload.

Hagerstown MD cops are feeling the heat, and rightly so, after video of them assaulting a 15 year old girl who had been struck by a car has gone viral. In an ideal world, I’d say this story is flat out unbelievable, but unfortunately, these days, it’s all too believable. I hope that every charge against the girl is dropped, and I hope to hell that cop shop is sued into the bloody ground. These armed assholes obviously think they are god, and are allowed to do whatever the hell they want to anyone.

Robin Ficker, the College Park, Md.,-based attorney who represents the girl’s family, said Wednesday that he met with the 15-year-old alleged victim and her mother on Monday morning and was informed the girl was riding her bike when she was struck by a vehicle Sunday afternoon. The impact, he said, caused the girl to strike her head and lose consciousness for about 30 seconds.

“She was dazed, then she got up and realized she was OK,” Ficker said.

An ambulance was called and the girl told paramedics that she didn’t want to go to the hospital. Ficker said police arrived and pulled the girl, who is 5 feet tall and weighs about 105 pounds, off her bike when she tried to ride away.

At this point, Ficker said, a police officer lifted the girl’s hands above her head from the rear and slammed her face into a wall.

“Her face hit the windowsill,” Ficker said.

He conceded that the girl, who has a white mother and a black father, resisted when officers tried to put her in the back of a cruiser.

The Optics Say Birmingham 1963, but It’s Standing Rock 2016, Or could it be Selma 1965, Bloody Sunday, when the President had to federalize the National Guard. Many of the water and land protectors may feel it’s like the Greasy Grass Fight in 1876, Alcatraz 1969 or Wounded Knee 1973. A new generation of activists are being passed the drums and pipes. But right now they need lawyers and funds to bail them out of North Dakota jails. Dozens more were arrested at the Red Warrior Camp including media with their cameras (probably to be used as evidence). If hundreds of the protectors went in to get arrested that would shut down the system. Perhaps shut down the camps too, but more people will come to sneak past the checkpoints, just like 1973.

The land they are on, folks keep calling it private property or Army Corps of Engineers land. But the Oceti Sakowin say the land was theirs until the Army Corps of Engineers at the behest of North Dakota politicians came in and flooded Standing Rock and Cheyenne River lands where Lake Oahe is now. There was no consultation and no compensation for their homelands, for this violation of the Ft. Laramie Treaty of 1868. Now it’s where the Dakota Access Pipeline threatens to be built 100 feet below, crossing the Missouri River three times. The Indians say the whites flooded the river, stole their land and left them nothing but poverty.

What we Natives are fighting, among many things, is the perceived numbers against us. We cannot deny that we are the very bottom 2% of the population. For every person talking about #NoDAPL and #Standing Rock, nine are arguing over various media distractions. But don’t get mad, just get even. Keep talking, texting, tweeting, posting, writing about #NoDAPL, Sacred Stone, Red Warrior, the indigenous activists coming from around the world and Lawrence O’Donnell too. Billionaire Kelcy Warren set-up his Energy Transfer Partners as a Master Limited Partnership (MLP) company which does not pay taxes. North Dakota politicians are in lock step with the oil & gas industries, Congressman Kevin Cramer as an energy advisor – and climate change denier – to Donald Trump (see no evil), Senator John Hoeven who sits on both Native American and Energy Committees (hear no evil), and Senator Heidi Heitcamp’s non-sequitur responses who also sits on a Native American Committee (say no evil). Is this a pattern of conflict of interests in North Dakota?

Natives are told to go home, do your protest legally, petition the government as citizens do and depend on the courts. Sovereignty, treaties, environmental justice?

Kelcy Warren and the ETP strategy is to keep buying up weaker pipeline, oil & gas companies, because the price of oil is low. The plan for DAPL/ETP in Iowa was all this dirty fracked Bakken oil in the pipelines was for domestic consumption. But Congress changed the 40 year ban to allow U.S. companies to export crude oil, this dirty fracked Bakken oil, to counter the oil price war the Saudis have unleashed on the world. All thanks to Warren’s friend, ex-Texas Governor Rick Perry who joined the board of ETP and lobbied to end the ban.

It’s no longer about American Energy Independence but outright profits for the U.S. and foreign banks who’ve invested in a futures deal to get cheap oil to their countries. The biggest problem for the citizenry (and for ETP) is that these huge pipelines need to be full to maximize profits. Bakken crude is dirty and needs to be heated to move better. This bakes the soil and along with oil and brine spills, the once black fertile land becomes useless. ETP heats, cools, or liquefies the oil & gas for its 70,000 miles of pipelines and is aiming for a goal of 150,000 miles. ETP says, “this is a growth project” and they are “exceptionally well positioned to capitalize on U.S. energy exports.” So forget any carbon reduction and pollution treaties, this sets the stage for more fracking and environmental degradation for years.

But the nation and the world is watching now. I remember the story, the Crow scouts told Lt. Col. Custer the day they looked down at the biggest gathering of Indians anyone had seen. You don’t have enough bullets for all the Indians down there. Custer didn’t believe, didn’t care about those numbers.

We got to think like that, that whatever they think they got, we got more. They fight for a paycheck. We fight for all we got and all we will have and all that we lost. We got them now. Now it’s them stuck in the past trying to impose a nationwide system of pipelines that will degrade the environment for the next 50 years. The Native water and land protectors, #NoDAPL, the Raging Grannies, farmers and ranchers of Iowa, Bold Nebraska now Bold Alliance that took down Keystone XL, all need to prepare to fight for the future. The country needs to rebuild its infrastructure, go into debt if need be to create millions of jobs not just thousands, with new transmission lines for all manner of green energy projects and not just pipelines. This is the time to start the switch to renewables.

Remember The Greasy Grass River 140 years ago. They don’t have enough “bullets” if we all stand up.

I’m just going to add a reminder here: when you read or hear “light and sweet” or “like olive oil” in regard to oil, remember that you’re drinking oil’s kool-aid. It’s marketing. They want people to think of honey or other food, because in our minds, we consign honey, syrup, or plant oils to the good category. If this oil was that manner of good, it wouldn’t poison land and water. If this oil was that manner of good, the white people of Bismarck wouldn’t have gotten upset about the pipeline running north of them. It’s toxic. It’s poison. It kills. It renders water into death, not life. It is inimical to life. Oil is invested in this type of marketing so that people won’t question, won’t try to stop them. They count on such marketing to keep the majority of people on their side of things.

Tulsa, Oklahoma, A History of Hate.

A brief look at Tulsa’s history, and it’s not at all a good one.

The black neighborhood in Tulsa was known as “Greenwood” because Greenwood Avenue ran through it. Approximately 10,000 African Americans lived there. While there were large numbers of black people who lived in poverty in the area, the business district was its own complete city. There were dozens of black-owned businesses. Every kind of small business — grocery stores, beauty shops, jewelry stores, photography studios, tailor shops, and much more — a large number of restaurants, and a 750-seat theatre, the Dreamland Theater “that offered live musical and theatrical revues as well as silent movies accompanied by a piano player.” There were two black-owned newspapers. There were 15 African American physicians’ offices. A hospital. A large number of churches. A library. And a 54-room hotel, the Stradford Hotel.

During the night and the following day, the white mob invaded Greenwood. They pulled residents out of their homes and beat and killed them, including old people and children. They torched every building. Black people escaping Greenwood were arrested by the Oklahoma National Guard, who locked masses of them up in holding centers and only released them when white people stepped forward and vouched for individual black people.

The best estimates are that 300 people died during the riot, and 1256 structures were torched. While the Red Cross provided relief efforts for those thousands of people who had been burnt out of their homes, for which the city and county paid into the Red Cross relief fund, no compensation was paid to the victims of the violence. In addition, not a single white person was held accountable for any of the crimes committed May 31-June 1.

I had never heard of this before, and it’s unconscionable that to this day, it’s barely acknowledged, and no restitution or compensation was ever offered. Tulsa’s history with people of colour is a dark and shameful one. It’s time to bring it all out into the light in the spirit of change, and one of those should be a vow to stop murdering people of colour. It’s been going on much too long, as the recent murder of Terence Crutcher demonstrates all too well.

It is with queasy despair followed by anger that I see yet another person dead, murdered by cops.

Dash cam video released by the Tulsa Police Department on Monday showed 40-year-old Terence Crutcher with his hands above his head moments before he was shot and killed by one of the officers at the scene.

At a press conference on Monday, Chief Chuck Jordan explained that the video was “very disturbing — very difficult to watch.”

The video shows multiple police cruisers approach Crutcher’s vehicle, which appears to be broken down in the middle of the road. Crutcher is seen with his hands in the air. Both hands appear to be empty.

Pastor Rodney Goss of Morning Star Baptist Church, who was able to view the dash cam video as well as video from other department vehicles, said that all views showed Crutcher’s hands in the air.

Goss also denied claims made by a police spokesperson that suggested Crutcher was shot because he refused to obey commands.

“It was not apparent at any angle from any point that he lunged, came toward, aggressively attacked, or made any sudden movements that would have been considered a threat or life-threatening toward the officer,” Goss told Tulsa World.

The article at Tulsa World is full of assurances that justice will be done, and the cop who murdered Mr. Crutcher, Betty Shelby, has been placed on administrative leave. I have to question those assurances of justice, because we’ve all heard that one before, over way too many corpses. There’s also much murmuring about “can’t talk about it yet” “might be criminal charges, we need to investigate” and “we don’t know how long an investigation will last”.

We have to stop asking what the dead person may or may not have done. This is akin to justifying rape as something caused by the victim. We need to be asking, in our shoutiest voices, why cops are murdering, and why they are allowed to get away with it. I don’t much care what any ‘suspect’ does, it’s going to be a very rare case indeed which actually calls for being gunned to death. There are plenty of examples of cops handling highly dangerous people, and everyone gets through it alive. We need to asking why, if cops are so darned scared, why are they being allowed to wander about with weapons, and interacting with people? This has to stop, and if police, as they have so far shown, continue to be unwilling and unable to police their own, we will have to do it for them.

My heart and thoughts go out to Mr. Crutcher’s family and friends, who must be lost in shock and grief.

And then you have things like this, a cop viciously assaulting a person on the ground, and who was left to carry on as a cop until late August (the assault took place in April this year) because

Indicting Cops: Racism is alive and well.

Ohio, which has a very bad record when it comes to violent cops is once again in the spotlight. One Cleveland officer has been indicted for negligent homicide, and two former officers have been indicted for kidnapping and assault (East Cleveland). What’s different in these cases is that all three officers are black men. Because of that, I expect there will be convictions in these cases. This comes after a very long string of white cops being kinda sorta indicted, then allowed to walk. That was certainly what happened in the case of Tamir Rice. So far, there’s been precious little justice to be had in all the cases of white cops viciously beating and murdering non-white people. People come oozing out of the woodwork to defend one white cop after another. It will be interesting to see if that holds true in the case of non-white cops.

In Columbus, Ohio, cops shot an innocent 13 year old to death, and they are busy blaming another black youth for that murder. If the cops who gunned Tyre King down are white, I expect nothing will happen. Okay, back to Cleveland.

In the Cleveland case, officer Alan Buford, who is black, was indicted for misdemeanor negligent homicide in the 2015 death of unarmed-breaking and entering suspect Brandon Jones, 18, Cuyahoga County Prosecutor Timothy J. McGinty said in a statement Friday.

“It is not reasonable for a police officer to use deadly force if he or she does not believe a suspect poses a threat of death or serious bodily harm to the police or the public,” McGinty said.

Interesting how using deadly force against a suspect who does not pose a threat of death or serious bodily harm is all manner of reasonable when the cop in question is white.

In the East Cleveland case, two former officers, Denayne R. Davidson-Dixon and Gerald A. Spencer II, were indicted on three counts of kidnapping, two counts of dereliction of duty and one count each of felonious assault, conspiracy, obstructing official business and interfering with civil rights for the July 2016 beating of Jesse R. Nickerson, a prisoner in their custody.

The two officers are black, as is Nickerson.

According to prosecutors the officers arrested Nickerson and after arguing with him drove to a park near the police station, pulled him from the squad car and assaulted him.

Davidson-Dixon and Spencer were fired shortly after the incident.

Oh look, some cops were actually fired! Ah, but they are black. White cops, no matter how vicious, bigoted, and violent they are, seem to manage to hang onto their jobs without much problem. Oh yes, I know two or three are fired now and then, but most aren’t. They are allowed to keep their job, so they can murder again. So as non-white people continue to die at the hands of cops, it’s been confirmed that the only way there might be justice is if the bad cops happened to be people of colour too.

Standing Rock: Camp Story, Part 7.

And then…the rain came. No big deal at first, just a bit of rain. It didn’t stay a bit of rain though. People rushed to grab ponchos or trash bags, then went back to getting coffee and breakfast.

Before the rain got serious though, back when I was still sitting around the council fire (pictured above), everyone was having a quiet moment when a thin blonde woman rushed up and sat down two chairs over from me. A reporter of some type, clutching pen and clipboard, began asking questions of the young man next to me. I wasn’t paying much attention, until I heard him talking about Arvol Looking Horse, then I looked over in time to see the young man trying to make a point of spelling Arvol correctly, when she interrupted and hand-waved, saying “I can look it up later.” The disregard and disrespect was shocking, and it showed on faces, but she was oblivious. It was clear that she hadn’t taken so much as five minutes to talk to anyone, or to try and understand what was going on at the camps. Then she started asking the young man questions, attempting to find out who someone was, and she was describing badly, but it was clear to me she was describing Dennis Banks. So, I said “Dennis Banks. That’s Dennis Banks.” She stared up with a rather blank and confused face, and said, but the man kept talking about Dennis Banks. I stared for a moment, nonplussed, as did the others, then explained, “yes, he was talking about the court case, you know, in the ’60s – The United States of America vs Dennis Banks and Russell Means.” Still a somewhat confused look, then she scribbled something down, thanked me profusely and ran off. The quality of media coverage leaves one hell of a lot to be desired, and that’s the very least I could say. Everyone is welcome at the camps, but please, if you’re a completely clueless person, at least listen, don’t be an unconcerned hand-waver. I sincerely hope I don’t see Ms. Blonde I can look it up later again. Okay, back to the rain!

Standing Rock: Camp Story, Part 6.

Finally, we arrive at Wednesday morning. Like most people, we arose with the sun, more or less, joining the other sleep dusted people wandering about and waking up. A woman drove by in her tiny car, packed full, steering with one hand, brushing her teeth with the other. Curls of woodsmoke lazily drifted from banked fires. We went off in pursuit of coffee. Started to feel a bit more woke, and took the second cuppa over to the circle of chairs around the council fire. Sat and listened to people talk, and it wasn’t long before Travis Harden stopped by, and regaled us with a groaningly awful joke, which got boos and laughs. Some new people came and sat, and we talked about where they were from, and other things. Rick decided to grab his walking stick and go walkabout. I’m kind of hard to move from that fire, especially in the morning. It’s nice there, and people come and go, you get to meet all kinds of people, talk, and have fun. Rick got back in time for oatmeal with raisins, while I continued to drink coffee like I had never tasted it before. The clouds got heavier, and it was a bit chill, so we went back to camp to get warmer clothes, then I went on walkabout with Rick. We had a nice meander by the banks of the Cannon Ball river, saw gumweed, licorice, and more, and said a good morning to the grasshoppers.

Breaking: National Guard Called In.

Chairman Archambault II spoke with the governor this morning and was notified of action by the National Guard to ensure safety of all citizens. The National Guard has been called in to assist state and county police in notifying drivers on Highway 1806 traveling south that there may be pedestrians on the road and cars may be parked on the side of the road. This is intended to keep all drivers and pedestrians safe. The National Guard will not enter the camp.

This was appended to a media statement, an appeal for peace in advance of the ruling tomorrow. I don’t think anyone needs to be told what an unnecessary, chickenshit move this was by Governor Dalrymple, oil’s best friend and investor. I suspect this was not in anticipation of the ruling tomorrow, but a favour to oil, whose propaganda has suffered a bit lately, after the move with the savage dogs and handlers attacking the protectors. We hold fast, we hold strong, we hold in peace.

CANNON BALL, ND—The Standing Rock Sioux Tribe filed an emergency motion Sunday for a temporary restraining order to prevent further destruction of the Tribe’s sacred sites by Dakota Access Pipeline.

“On Saturday, Dakota Access Pipeline and Energy Transfer Partners brazenly used bulldozers to destroy our burial sites, prayer sites and culturally significant artifacts,” Tribal Chairman David Archambault II said. “They did this on a holiday weekend, one day after we filed court papers identifying these sacred sites. The desecration of these ancient places has already caused the Standing Rock Sioux irreparable harm. We’re asking the court to halt this path of destruction.”

After the initial destruction Saturday, Dakota Access Pipeline returned to the area and dug up additional grounds in the pre-dawn hours Sunday, Archambault said.

The motion seeks to prevent additional construction work on an area two miles west of North Dakota Highway 1806, and within 20 miles of Lake Oahe until a judge rules on the Tribe’s previous motion to stop construction.

That motion is based on the Standing Rock Sioux’s assertion that it was not properly consulted before the U.S. Army Corps of Engineers fast-tracked approval of the pipeline project.

A decision on the case, filed in the U.S. District Court for the District of Columbia, is expected by Sept. 9.

“Destroying the Tribe’s sacred places over a holiday weekend, while the judge is considering whether to block the pipeline, shows a flagrant disregard for the legal process,” said Jan Hasselman, attorney for the Standing Rock Sioux. “The Tribe has been seeking to vindicate its rights peacefully through the courts. But Dakota Access Pipeline used evidence submitted to the Court as their roadmap for what to bulldoze. That’s just wrong.”

In a statement released in a live-stream on Facebook, Red Warrior Camp leaders said that at about 3pm on Saturday September 3, “water protectors successfully stopped pipeline construction as it reached Hwy. 1806 through nonviolent direct action and mass assembly.”

As they did so, private security guards working for Dakota Access LLC “deployed vicious attack dogs, pepper spray and physical assault against the water protectors,” Red Warrior said. “According to the most recent update, six water protectors were bitten by dogs, a dozen or more pepper sprayed, while others were physically assaulted, including women. A helicopter was photographed flying over the area.

According to many witnesses at the scene, neither state nor county law enforcement officials were at the construction site during the incident. It is extremely suspicious to me that law enforcement became scarce at the exact time when DAPL’s hired guns were planning to attack the water defenders. A press release recently issued by the Morton County Sheriff’s Department insinuates that the peaceful protesters were the provokers of the incident because several individuals allegedly cut a fence and entered the work site. State and local law enforcement officials keep telling the media, without proof, that the protesters are committing unlawful acts. In my opinion unleashing vicious attack dogs on women and children, and spraying dozens of unarmed people simply because they are exercising their constitutional right to assemble, is unlawful.

I am calling on all members of the Cheyenne River Sioux Tribe to avoid traveling to or doing business in the Mandan-Bismarck area until this crisis is resolved. I fear for my people’s safety. Today’s act of terrorism shows us how desperate DAPL and the State of North Dakota government are to keep things at a status quo. I am concerned about the escalating violence against Natives in that area.

When will Governor Dalrymple step up and meet with Tribal leadership in an open, good faith effort to resolve this conflict? The key to settling this situation is in the hands of North Dakota leadership. I requested a meeting with Governor Dalrymple last week, but as of today has received no response.

Cop Unions, What Are They Good For?

Actually, that should be: Cop Unions, What in the Fuck Are They Good For? It would appear that they simply sit around, twiddling their thumbs until someone manages to hurt their collective feelings. “Woe is us” goes the shout, whereupon they start acting like tiny aggrieved children on the brink of a tantrum. They moan. They whine. They spill crocodile tears. They extort.

I’m not one to be terribly surprised by cop behaviour, but I’ll admit to surprise with the blatant move into extortion by cop unions over the tiniest hint that they might not be earth’s mightiest heroes. No, cops, you are not earth’s mightiest heroes. In this particular case, you aren’t San Francisco’s mightiest heroes, either. You might make the cut for San Francisco’s mightiest villains, if that makes you feel better. The SFPD has been exposed as corrupt, and racist as all hells. So, no one at all will be shocked that the SF cop union is issuing threats along with their extortion. (You can read the full letter here, scroll down.)

The union representing Santa Clara police threatened on Friday to boycott San Francisco 49ers games because of Colin Kaepernick’s protest against police brutality, KNTV-TV reported.

“The board of directors of the Santa Clara Police Officer’s Association has a duty to protect its members and work to make all of their workings environments free of harassing behavior,” the group said in a letter to the team, which plays its home games in that city.

If the team does not take action against the quarterback, the letter stated, “It could result in police officers choosing not to work at your facilities.”

So, now it’s harassment and a hostile work environment if one person sits during the anthem, or wears socks cops don’t like. Wow. Who knew a gigantic sportsball stadium could turn completely hostile by the actions of one person in a crowd of, what, thousands? Seems to me that private security could be hired for as much, or possibly less, than cops. Or, perhaps cops who don’t want to work the stadium don’t have to, and those who want to work can do so. Oh, but that would end up with the working cops being subjected to an actual hostile work environment, wouldn’t it? I sincerely hope the cops are given a polite fuck off, with private security hired, so they can go back to twiddling their thumbs while writing racist texts to one another, often about their own co-workers:

However, Kaepernick also took note of the findings regarding San Francisco officers’ tendency to send one another racist text messages. A panel of three judges also determined that the department showed “institutionalized bias” against communities of color.

“The SFPD has had a lot of issues,” Kaepernick said on Thursday, adding that the officers in question were “not only talking about the community, but talking about colleagues that work in the same department.”
